Buying an Existing Short-Term Rental? Read This First
"It's already an Airbnb" is the most dangerous sentence in a Las Vegas listing, because whether that means anything to you depends entirely on which jurisdiction the property sits in. In one, the license you are buying is the most valuable thing in the transaction. In another, it evaporates at closing.
Henderson: the registration dies at closing
A Henderson short-term vacation rental registration is valid only for the owner it was issued to, and it terminates on sale. The buyer must apply fresh and qualify under the rules in force on the day they apply, not the rules that existed when the seller registered.
That matters more than it sounds, because the 1,000 ft separation is measured against currently registered rentals. If neighbors registered after the seller did, the property that qualified in 2024 may not qualify for you now. The seller's operating history is not evidence that you will be approved.
This is the single biggest trap when buying an existing Henderson short-term rental, and it is frequently misrepresented in listings, usually through genuine ignorance rather than intent.
Unincorporated Clark County: the license is the asset
The county runs the opposite way. New licenses are unavailable, but an existing county license can transfer with a sale. Since the county issued roughly 230 licenses and has not reopened applications, buying a property that already holds one is currently the only realistic way into unincorporated county short-term rentals.
Which means the license, not the house, is what you are paying the premium for. It deserves the same diligence you would give a title issue: confirm it exists, confirm it is current, confirm it is in good standing, and confirm in writing with the county what the transfer requires. The county's ordinance is also partially enjoined and under appeal, so ask what happens to the license under each outcome.
City of Las Vegas and North Las Vegas
In the City of Las Vegas the binding constraint is not transferability but occupancy: the owner must live in the home during every rental period, and the property can have no more than three bedrooms including the owner's. An existing operation tells you the property qualified for someone who lived there. If you do not intend to live there, the history is irrelevant to you.
In North Las Vegas the entitlement is a Conditional Use Permit obtained before the business license. Confirm with Planning and Zoning at 702-633-1537 what happens to an approved CUP on transfer rather than assuming it rides along with the deed.
The diligence list
- Confirm the jurisdiction from the parcel, not the listing description or the mailing address.
- Ask for the license or registration number and verify it directly with the issuing office. Do not accept a screenshot.
- Ask the office, in writing, what happens on transfer.
- Re-run the separation distances as of today, not as of when the seller applied.
- Re-read the HOA documents yourself against today's requirements.
- Write the contract so you can walk if the registration or permit is denied.
