Is Airbnb legal in Las Vegas?

It is - but which rules apply depends on which of four jurisdictions your address falls inside, and the answer is often not the one on your mail.

Yes - Airbnb is legal in the Las Vegas valley, but "Las Vegas" is not one place with one rule book. Four separate governments write the rules here, and a home with a "Las Vegas, NV" mailing address is frequently not in the City of Las Vegas at all. The answer for your house depends entirely on which line on the map it sits inside.

The short answer, by jurisdiction

Most of the valley's best-known neighborhoods - Summerlin, Southern Highlands, Mountain's Edge, Enterprise - carry Las Vegas addresses but sit in unincorporated Clark County, where no new licenses are being issued. That single fact ends more deals here than every other rule combined.

Henderson

Henderson calls these Short-Term Vacation Rentals (STVR) and issues an annual registration on a first-come, first-served basis. There is no lottery and no citywide cap. In practice the two things that kill most Henderson deals are (1) a common-interest community whose CC&Rs do not expressly authorize transient lodging, and (2) being within 1,000 feet of an already-registered STVR.

City of Las Vegas

The City of Las Vegas is the most owner-restrictive jurisdiction in the valley. The property must be owner-occupied during the entire rental period and can have no more than three bedrooms total, including your own. That makes it workable for a house-hacker and essentially impossible for a pure absentee investor.

North Las Vegas

North Las Vegas allows short-term rentals only with an approved Conditional Use Permit (CUP), obtained before you apply for a business license (Ordinance 3127, 2022). Unincorporated Clark County

The county's only application window ran September 2022 to August 2023 and was awarded by random-number lottery. It has never reopened. Roughly 230 licenses were ever issued against an estimated 16,000 active listings. In December 2025 a federal judge enjoined enforcement of major parts of the ordinance, the county voted to appeal in January 2026, and in August 2026 the Commission moved toward making booking platforms block payments to unlicensed properties instead. If your address is in unincorporated county, there is no legal path to a new license today.
